Commencing 1 July 2025, the Electoral Disclosure and Funding Act 2023 established a new scheme for disclosing political donations and electoral expenditure in parliamentary elections, and administering public funding in relation to House of Assembly elections in Tasmania.

The Tasmanian Electoral Commission has developed a suite of information, available on this website, to help electoral participants understand their obligations under electoral legislation, and support their new disclosure and funding requirements.

The Disclosure and Funding Act

The Act aims to enhance public confidence in Tasmanian parliamentary elections by promoting awareness of political donations and electoral expenditure, and preventing undue influence by political donors and foreign donors.

The Electoral Disclosure and Funding Act 2023 expands on Tasmania’s existing electoral expenditure and political party registration framework under the Electoral Act 2004. It introduces new provisions for:

  • the registration of other electoral participants, like candidates and third-party campaigners
  • the prohibition of certain political donations, including from foreign donors
  • campaign finance regulations that require the use of campaign bank accounts
  • the disclosure of electoral expenditure and political donation information by electoral participants, with public access to this information, and
  • the introduction of party agents and official agents who are responsible for the disclosure obligations of electoral participants and documentation in relation to funding.

The Disclosure and Funding Regulations

The Electoral Disclosure and Funding Regulations 2025 were made on 26 June 2025, and take effect with the Electoral Disclosure and Funding Act 2023 on 1 July 2025. The Regulations support the implementation of specific sections of the Act, prescribing:

  • how electoral participants who receive reportable political donations must receipt or acknowledge the donation
  • how political donations and electoral expenditure must be vouched for in disclosures, and
  • the provision of campaign bank account statements to the Commission.

Who has disclosure and funding obligations?

The Electoral Disclosure and Funding Act 2023 identifies electoral participants who have new obligations and entitlements under this scheme. Electoral participants are any person, group of people or other entity who either incur electoral expenditure, or make or receive political donations. They can be political parties, members of parliament, candidates, intending candidates, associated entities, third-party campaigners, political donors, party agents or official agents.
